By booking with AJ Photography, you agree to the terms outlined below. These terms are designed to protect both the client and photographer by clearly explaining booking policies, payment expectations, image usage rights, delivery timelines, cancellations, and copyright ownership.

Welcome to AJ Photography. These Terms of Service outline the terms and conditions for booking photography services with AJ Photography, including portrait sessions, pet photography, weddings, events, commercial portraits, and other photography services.
By booking a session, paying a retainer, signing a contract, or using our services, you agree to the terms outlined below.
1. Services Provided
AJ Photography provides professional photography services, which may include but are not limited to:
Pet photography
Portrait photography
Wedding photography
Event photography
Business, branding, and social media portraits
Image editing and digital gallery delivery
The specific services, date, location, package, deliverables, and pricing will be outlined in your booking agreement, invoice, or written communication with AJ Photography.
2. Booking and Retainers
A booking is not considered confirmed until the required retainer has been paid and AJ Photography has confirmed the session date and time.
The retainer reserves your selected date and time and allows AJ Photography to decline other bookings for that period.
A retainer invoice will be issued separately and must be paid within 15 days in order to secure the booking.
Unless otherwise stated in writing, retainers are applied toward the total cost of your photography package.
3. Payment Terms
Payments are to be received within 30 days of invoice.
For bookings requiring a retainer, the retainer invoice will be issued separately and must be paid within 15 days in order to secure the booking.
AJ Photography reserves the right to withhold image delivery, galleries, prints, albums, or other final products until all outstanding balances have been paid in full.
Late or unpaid invoices may result in delayed delivery, cancellation of services, or additional collection efforts where permitted by law.
4. Cancellations, Refunds, and Rescheduling
Clients must provide as much notice as possible if they need to cancel or reschedule a session.
Retainer Fees
Refunds will not be issued on the retainer fee unless AJ Photography is responsible for the cancellation.
Other Services
Other services are non-refundable once final images have been delivered.
Rescheduling
Rescheduling attempts will be made within reason, provided sufficient notice is given.
For in-town sessions, at least 48 hours’ notice is required. For out-of-town sessions, at least 15 days’ notice is required.
Rescheduling is subject to AJ Photography’s availability and cannot be guaranteed. Weather-related rescheduling for outdoor sessions may be permitted at the discretion of AJ Photography.
5. Late Arrival and No-Shows
Clients are expected to arrive on time for their scheduled session.
If a client arrives late, the session may still end at the originally scheduled time. AJ Photography is not responsible for reduced image quantity or missed shots due to late arrival.
If the client does not attend the session and does not provide notice, the session may be considered cancelled, and any payments made may be forfeited where permitted by law.
6. Session Cooperation
The client is responsible for cooperating during the session and for ensuring that all participants, including children, pets, family members, guests, or employees, are present and prepared.
For pet sessions, the client is responsible for the safety, handling, and behaviour of their pet at all times.
AJ Photography is not responsible for missed images due to lack of cooperation, unpredictable behaviour, time limitations, venue restrictions, weather, or circumstances outside of AJ Photography’s control.
7. Weddings and Events
For weddings and events, AJ Photography will make reasonable efforts to capture key moments, details, and requested images. However, due to the live and unpredictable nature of events, no specific photo, pose, person, or moment can be guaranteed.
The client is responsible for providing accurate timelines, locations, contact information, venue rules, and any requested shot lists before the event.
AJ Photography is not responsible for missed images caused by schedule delays, restricted access, lighting limitations, guest interference, weather, venue rules, or changes to the event timeline.
8. Image Editing and Style
Clients acknowledge that they are hiring AJ Photography based on its artistic style, editing approach, portfolio, and creative judgment.
All final images are selected and edited at the discretion of AJ Photography. Standard editing may include colour correction, exposure adjustment, cropping, tonal adjustments, and general image enhancement.
Extensive retouching, object removal, body modification, background replacement, or advanced editing may be available for an additional fee.
Unedited RAW files are not included unless specifically agreed to in writing.
9. Image Delivery
Final edited images will be delivered through an online gallery, digital download, USB drive, print order, or other agreed method.
Estimated delivery times will be provided at booking. Delivery timelines may vary depending on the type of session, workload, season, and complexity of editing.
AJ Photography will make reasonable efforts to deliver images within the estimated timeframe, but delivery dates are estimates and not guarantees unless specifically stated in writing.
10. Digital Galleries and Downloads
Online galleries will remain active for 90 days unless otherwise stated in writing.
Clients are responsible for downloading and backing up their images before the gallery expires. AJ Photography is not responsible for storing client images indefinitely. Re-uploading archived galleries may be subject to an additional fee.
11. Copyright and Image Ownership
AJ Photography retains the copyright and ownership of all photographs created, unless a separate written agreement states otherwise.
Clients receive a personal-use license to download, print, and share their final edited images for personal purposes.
Clients may not sell, alter, edit, apply filters to, enter into contests, publish for commercial use, or transfer images to third parties for commercial purposes without written permission from AJ Photography.
For commercial, branding, or business photography, usage rights will be defined in the client’s specific agreement.
12. Client Usage Rights
Clients may use delivered images for personal use, including:
Printing for personal display
Sharing with family and friends
Posting on personal social media
Using as personal profile photos
Creating personal photo books or keepsakes
When sharing online, credit to AJ Photography is appreciated but not required unless otherwise agreed.
Commercial use, business advertising, paid promotions, resale, publication, or brand use requires written permission or a separate commercial license.
13. Photographer Portfolio and Promotional Use
AJ Photography may request permission to use selected images for portfolio, website, social media, advertising, studio samples, print materials, or promotional purposes.
Where required, AJ Photography will obtain appropriate consent or a model release before using identifiable client images for promotional or commercial purposes.
Clients who do not wish their images to be used publicly should notify AJ Photography in writing before or at the time of booking.
14. Printing and Colour Accuracy
Clients may print images through the recommended professional lab or through a third-party printer of their choice.
AJ Photography is not responsible for print quality, colour accuracy, cropping, paper choice, or image appearance when printed through third-party labs, drugstores, online printers, or consumer printing services.
For best results, clients are encouraged to order prints directly through AJ Photography or a recommended professional print provider.
15. Client Edits and Filters
Clients may not alter final images in a way that changes the artistic integrity of the work. This includes applying filters, heavy edits, AI modifications, colour changes, or retouching without written permission.
Cropping for social media use is permitted, provided the image is not otherwise altered in a misleading or damaging way.
16. Travel and Location Fees
Travel within St. John’s and surrounding areas is included unless otherwise stated.
Additional travel fees may apply for sessions outside the standard service area and will be discussed before booking.
Clients are responsible for any required location fees, permits, admission costs, parking fees, or other charges associated with the selected session location unless otherwise agreed in writing.
17. Permits and Venue Restrictions
The client is responsible for ensuring that photography is permitted at the chosen location, unless AJ Photography has specifically agreed to handle permits.
AJ Photography is not responsible for cancelled, interrupted, or restricted sessions due to lack of permits, venue rules, security intervention, property restrictions, or access limitations.
18. Weather and Outdoor Sessions
Outdoor sessions are subject to weather conditions.
AJ Photography may recommend rescheduling due to rain, heavy wind, unsafe conditions, poor visibility, or other weather-related concerns.
Cloudy or overcast conditions do not automatically require rescheduling, as they may still be suitable for photography.
19. Pets, Children, and Safety
For sessions involving pets, children, or vulnerable individuals, the client is responsible for supervision and safety at all times.
AJ Photography may stop or pause a session if conditions become unsafe for the client, photographer, pet, child, or others present.
Clients are responsible for any damage, injury, or liability caused by their pets, children, guests, or property.
20. Limitation of Liability
AJ Photography will take reasonable care in providing photography services, handling equipment, and storing images.
However, in the unlikely event of equipment failure, file corruption, illness, accident, injury, weather disruption, emergency, or other circumstances beyond AJ Photography’s control, liability is limited to the amount paid by the client for the affected service.
AJ Photography is not responsible for indirect, incidental, emotional, consequential, or financial damages arising from the use or inability to use the services or images.
21. Force Majeure
AJ Photography is not liable for failure to perform services due to circumstances beyond reasonable control, including but not limited to severe weather, illness, accident, fire, natural disaster, government restrictions, road closures, venue closure, power outage, equipment theft, or other emergencies.
If such circumstances occur, AJ Photography will make reasonable efforts to reschedule or provide an appropriate alternative where possible.
22. Client Responsibilities
The client agrees to:
Provide accurate contact and booking information
Arrive on time and prepared for the session
Pay all fees by the required due dates
Communicate any important details, restrictions, or special requests before the session
Obtain any required permissions for private locations
Ensure participants, guests, children, and pets behave safely and respectfully
23. Refusal of Service
AJ Photography reserves the right to refuse or discontinue service if a client or participant behaves in a threatening, abusive, discriminatory, unsafe, harassing, or inappropriate manner.
If a session is ended due to unsafe or inappropriate behaviour, refunds may not be provided.
24. Privacy
AJ Photography respects client privacy and will only collect personal information necessary to provide photography services, communicate with clients, process payments, deliver galleries, and manage bookings.
Client information will not be sold or shared with third parties except where necessary to provide services, process payments, deliver products, comply with legal obligations, or with the client’s consent.
25. Website Use
All content on the AJ Photography website, including images, text, branding, graphics, and design elements, is owned by or licensed to AJ Photography.
Visitors may not copy, download, reproduce, alter, distribute, or use website content without written permission.
26. Changes to These Terms
AJ Photography may update these Terms of Service from time to time. The updated version will be posted on the website with a revised “Last Updated” date.
For booked clients, the terms in effect at the time of booking will generally apply unless otherwise required by law or agreed in writing.
27. Governing Law
These Terms of Service are governed by the laws of the Province of Newfoundland and Labrador and the applicable laws of Canada.
Any disputes will be handled in the appropriate courts or dispute resolution forums of Newfoundland and Labrador, unless otherwise required by law.
